I got engaged during my trip and my marriage has been fixed in Nov'08. Last week, I came back from my India trip. Two months back my I-140 got approved and I was waiting for the priority date to be current.
The known understanding was that I will join his company in near future, apply the I-485 and get the GC.
Even after that, due to the good terms with my previous employer he agreed to apply for my I-140 during 2007 June and I took care of the financial aspect of it. In between, heĪpplied the petition for my labor in April 2005 on eB2 Category and my responsibility was to pay for the GREEN CARD expenses.ĭuring Oct 2005, I joined an American company as permanent employee. I came to USA during Dec 2003 through a California based Indian Consulting firm. I have a tricky scenario here, I need some input/guidance. Recommend brining wide on H4 considering you have H1B once she is here you apply for her 485 along with yours.Ģ- Yes (but the job duties have to be relatively the same)ģ- tricky, if your employer revokes your i-140 before you file a change then you lose the date. WE REQUEST CONGRESS, TO PASS LEGISLATION - NOT TO COUNT ANY 245I VISAS AGAINST REGULAR QUOTA ( TO EXEMPT 245I VISAS FROM THE QUOTA). So these additional visas on top of 245i applications make it very hard for any prediction.ĮB-3(India) & ALL EB categories need very URGENT HELP from congress, as this situation has arised due to 245i LIFE ACT. I have also heard that relatives of 245i applicants are being issued immigrant visas at US Consulates abroad. I really do hope that, most of the 245i application visa adjudication would have been done. Unless congress passes some legislative change, it is very hard to determine the further progress in EB-3 India Category. There were no additional Immigrant visas approved for these applications and they are being issued visas from the regular quota.įull Text of Immigration Bill-12/15/00 ()
245i applicants ( the people who were out of status) were allowed to file for adjustment of status under LIFE ACT of year 2000 passed by congress.
